You agree to provide accurate, complete and up-to-date information required for delivering the requested services.
3. Enquiries, Quotations and Orders
Submitting an enquiry through our website, email, telephone or WhatsApp does not automatically create a confirmed project or guarantee service availability.
Before work begins, we may provide a quotation or proposal specifying the scope of work, deliverables, estimated timeline, fees, payment schedule and any exclusions.
A project will be considered confirmed when the relevant acceptance, advance payment or other agreed requirements have been completed.
Any work outside the agreed scope may require a separate quotation and additional charges.
4. Pricing and Payments
Our service prices may be displayed on the website or communicated through individual quotations. Unless expressly stated otherwise:
– Prices are quoted in Indian Rupees (INR).
– Applicable taxes, if any, will be communicated or charged as required by law.
– Domain registration, hosting subscriptions, premium themes, plugins, stock assets, paid software and other third-party charges may be additional.
– An advance payment may be required before project work begins.
– Milestone payments or the remaining balance must be paid according to the agreed payment schedule.
– Final website files, administrative access, launch or other deliverables may be subject to settlement of all undisputed amounts due under the agreement.
We will communicate any applicable payment terms before confirming your project. Please retain payment receipts and invoices for your records
5. Website Designing and Development
Website projects will be delivered according to the agreed scope, design direction, features and specifications.
Unless specifically included in the quotation, our services may not include:
- Ongoing website maintenance after the agreed support period.
- Premium themes, plugins, paid fonts or stock media.
- Custom software, complex integrations or additional functionality.
- Professional photography, extensive copywriting or translation.
- Hosting, domain renewals or third-party subscription fees.
- Continuous content updates, security monitoring or unlimited technical support.
We will make reasonable efforts to deliver work within the agreed timeline. Delivery dates may change if there are delays in receiving content, approvals, payments, access credentials or other required inputs from the customer or third parties.
6. Content, Materials and Customer Responsibilities
You are responsible for supplying the text, images, logos, product details, business information, credentials and other materials required for your project, unless their creation is specifically included in the agreed scope.
You confirm that you have the necessary rights, licences and permissions to use the materials you provide.
You are responsible for ensuring that your products, services, claims, business information and published content comply with applicable laws and do not infringe third-party rights.
Saraf Creations may request corrections or refuse to publish material that appears unlawful, deceptive, infringing or otherwise inappropriate.
7. Design Approvals and Revisions
We may share website layouts, drafts, graphics or development previews for your review.
You agree to review the work and provide clear feedback within a reasonable period. Revisions will be handled according to the number and type included in your quotation.
A revision means a reasonable modification to an agreed deliverable. A new design direction, additional page, major functionality change or request beyond the original scope may be treated as additional work and charged separately after approval.
Delays in feedback or approvals may affect the delivery schedule.
8. Intellectual Property and Ownership
Each party retains ownership of the intellectual property it owned before the project.
Subject to full payment and any written agreement, ownership or usage rights in specifically commissioned final deliverables will be transferred or licensed as stated in the relevant quotation or agreement.
Third-party software, themes, plugins, fonts, stock images, hosting platforms and other licensed materials remain subject to their respective licence terms. They may not be transferable or owned outright by Saraf Creations or the customer.
Unless otherwise agreed, we may retain ownership of our general methods, reusable components, tools, templates, know-how and pre-existing materials used to produce the deliverables.
We will not knowingly use customer-confidential materials in promotional content without permission. Any use of your project as a portfolio example, case study or testimonial will be subject to the applicable agreement and permissions.
9. Domain Registration
Where we assist with domain registration or renewal:
Domain availability is subject to confirmation by the relevant registrar.
Registration is subject to the registrar’s rules, eligibility requirements and policies.
A requested domain name is not guaranteed until registration is successfully completed.
Renewal fees, restoration fees and other registrar charges may apply.
You are responsible for providing accurate registration information and monitoring renewal dates unless a different arrangement is agreed in writing.
Domain registration does not automatically grant rights to a trademark or business name. You are responsible for checking that your chosen domain does not infringe third-party rights.
10. Web Hosting and Third-Party Providers
Hosting services may be supplied directly by a third-party hosting company, such as Hostinger, or arranged with your chosen provider.
Unless expressly stated otherwise in writing, Saraf Creations acts as a service provider assisting with setup, configuration, migration or support and does not represent itself as the hosting provider.
Hosting plans, server availability, storage limits, bandwidth, email facilities, backups, security features, renewal prices and support commitments are governed by the relevant provider’s terms and plan details.
We do not guarantee uninterrupted hosting, zero downtime or complete protection against cyberattacks. Any maintenance, migration or support we provide will be limited to the agreed scope.
Customers should maintain appropriate backups of their website files, databases, email and other important information unless backup services and responsibilities are expressly included in the agreement.
11. E-Commerce Websites
For e-commerce projects, the customer is responsible for the accuracy and legality of product listings, prices, descriptions, taxes, shipping terms, return policies, warranties and other business information.
Payment gateways, delivery partners, marketplaces and other external integrations are subject to their own eligibility requirements, fees, policies and availability.
Unless specifically agreed, Saraf Creations does not act as the seller of your products, fulfil your orders or assume responsibility for your transactions with customers.
You are responsible for complying with applicable consumer protection, tax, privacy, payment, advertising and other laws relating to your online store.
12. SEO and Digital Marketing Services
SEO and digital marketing results depend on factors that may be outside our control, including search engine algorithms, competitors, website condition, content quality, market conditions and third-party platform policies.
We will make reasonable efforts to provide the agreed services, but we do not guarantee specific search rankings, a number-one position, website traffic, leads, sales, revenue or a particular return on investment.
Search engines and other platforms may change their rules, features or ranking systems without notice. These changes may affect results even when work has been performed as agreed.
13. Cancellations, Refunds and Project Delays
Cancellations, refunds, rescheduling and project termination will be handled according to our separate Refund & Cancellation Policy, the applicable project agreement and relevant law.
Fees for completed work, committed third-party costs, subscriptions or services already delivered may be treated differently from unperformed work, subject to the agreed terms and applicable legal requirements.
If a project is delayed because required content, approvals, access or payments are not provided, the delivery schedule may be extended.
Nothing in these Terms removes any refund, cancellation or other rights that cannot lawfully be excluded.
